Are there any alternatives to surety bonds for those in the construction business? There are, but the tradeoffs will be hard to deal with. You can put up real or personal property in which case you will need a contract that clearly describes what obligation is being secured, and the obligation is secured by a deed of trust on the property. The problem with this is that finding a property with enough equity that is not encumbered by other claims. In addition, there is an elaborate process for confirming ownership of a property to secure an obligation, and it includes title searches among other things.
Another problem with using real property to secure an obligation is that real property is not generally liquid, as assets go, and even a property with adequate equity must be foreclosed one, which means that filing papers, talking to attorneys and twiddling your thumbs while the case wends its way through the courts. You could always use personal property as security, but many of the same problems exist: proper documentation of the obligation and the problem of liquidity, which is less of a problem compared to real property but still a large problem.
